Terms and Conditions

1. General Information

1.1 These Terms and Conditions govern the relationship between Top Travel & Tours, s.r.o. (hereinafter referred to as „the Company,“ „we,“ or „us“) and the customer (hereinafter referred to as „the Customer,“ „you,“ or „the Participant“).
1.2 The Company is a Czech Republic-based business registered under company ID (IČO) 01400223, with its registered address at Pštrossova 199/25, Nové Město (Praha 1), 110 00 Praha.
1.3 The Company specializes in providing guided tours to tourists in Prague and the surrounding regions.

2. Enquiries, Bookings, and Payments

2.1 Enquiries

• Customers can submit enquiries for tours through the Company’s website or by contacting us via email or phone.
• Submitting an enquiry does not constitute a confirmed booking or guaranteed availability. The enquiry serves as an initial request for information or for us to provide details about available tour options.
• Once we have reviewed the enquiry, a follow-up communication will be sent to the provided contact details to confirm availability, provide further details, and generate a payment link if the Customer wishes to proceed with the booking.

2.2 Booking Process

• A booking is confirmed only after the full payment is received and acknowledged by the Company.
• Once the payment is received, the Customer will receive a confirmation email or SMS containing the tour details, which will serve as proof of booking.
• Customers are responsible for ensuring they provide accurate contact information (email or phone) during the enquiry process to facilitate proper communication.

2.3 Payment Methods and Timeline

• Payments can be made in cash, via an online payment gateway, or through a payment link sent by email or SMS.
• Payment must be completed within 24 hours after receiving a payment link. If the payment is not made in this time frame, the requested tour slot may no longer be guaranteed.

2.4 Currency and Transaction Fees

• Payments are accepted in Euros (€) or in Czech Crowns (CZK).
• Any additional fees incurred due to bank or payment provider charges (e.g., foreign transaction or currency conversion fees) are the responsibility of the Customer.

3. Cancellation and Refunds

3.1 Cancellation by the Customer

• Customers may cancel their booking by notifying the Company via email or phone.
• Cancellations made more than 14 days prior to the scheduled tour date will be refunded in full minus a 10% processing fee (if applicable).
• Cancellations made less than 24 hours before the scheduled tour are non-refundable.

3.2 Changes or Cancellations by the Company

• The Company reserves the right to cancel or reschedule tours due to unforeseen circumstances, such as pandemics, strikes, or governmental restrictions, as well as health and safety concerns.
• In such cases, the Customer will be offered a full refund or an alternative tour date at their discretion.

4. Participation and Conduct

4.1 Customer Responsibilities

• Customers must arrive at the specified meeting point on time. Late arrivals may not be accommodated, and refunds will not be provided.
• Customers are required to follow all instructions provided by the tour guide to ensure safety and an enjoyable experience for all participants.
• The Company reserves the right to refuse service to individuals who disrupt the tour, exhibit inappropriate behavior, or are under the influence of alcohol or drugs. In such cases, refunds will not be issued.

4.2 Health and Limitations

• While the Company does not impose specific physical or health restrictions, some tours may involve walking for extended periods or require a moderate level of physical fitness. Participants are advised to assess their own ability to participate in advance.

5. Liability

5.1 The Company is not liable for injuries, illnesses, damages, loss of personal belongings, or delays caused by third parties, including transportation providers or vendors.
5.2 The Company is not responsible for circumstances outside of its control, such as adverse weather, extreme events (such as pandemics), strikes, or other force majeure scenarios.
5.3 The Company operates with valid insurance coverage in compliance with Czech Republic regulations. However, participants are strongly encouraged to purchase personal travel insurance to cover any additional risks.

6. Data Protection and Privacy

6.1 The Company collects and processes customer data in accordance with applicable EU and Czech data protection laws, including the General Data Protection Regulation (GDPR).
6.2 Personal data provided during the enquiry or booking process—including names, email addresses, and phone numbers—will be used solely to provide the requested service and facilitate communication with the Customer.
6.3 The Company will not share your personal data with any third parties without your express consent, except as necessary to fulfill the service or when required by law.

7. Governing Law and Disputes

7.1 These Terms and Conditions are governed by the laws of the Czech Republic.
7.2 Any disputes arising from or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of Czech courts.
